Die im 20. Jahrhundert im Namen von Staaten und politischen Ideologien begangenen Verbrechen haben in der jüngsten Vergangenheit und Gegenwart zu einer weltweiten Anerkennung von Menschenrechten geführt: Seit der "Deklaration der Menschenrechte" durch die Vereinten Nationen im Jahr 1948 sind die Menschenrechte zum Bestandteil von zahlreichen Verfassungen von Einzelstaaten erklärt und zum Inhalt vieler völkerrechtlicher Vereinbarungen gemacht worden. Sind Menschenrechte "vorpositive" Rechtsnormen, oder koinzidieren sie mit den "Grundrechten" einer Verfassung? Wer ist der Autor von weltweiten Menschenrechten? Können Strukturen weltweiter Politik auf Grundsätze aufbauen, die den Menschenrechten zu entnehmen sind?
